Welcome to BENIPAL LAB. These Terms & Conditions (“Terms”) explain the rules for using our website, mobile app, digital services, communication features, ordering flows, payment features, and related services.

2. Eligibility

By using BENIPAL LAB, you confirm that:

  • You are legally able to enter into these Terms.

  • You will provide accurate information when placing an order, contacting us, or using checkout features.

  • You will not use our website, app, or services for unlawful, harmful, abusive, fraudulent, or misleading purposes.

If you use BENIPAL LAB on behalf of a business, company, or organisation, you confirm that you have authority to act on behalf of that business, company, or organisation.

3. Orders, Services, and Project Requests

BENIPAL LAB may allow users to request services, place orders, submit special orders, request upgrades, or communicate with us about digital work.

Any order, quotation, project estimate, timeline, or service description shown in the app or website is provided for general service understanding unless clearly confirmed by BENIPAL LAB in writing.

A project or order may depend on:

  • The information supplied by the client

  • Required app, website, design, or backend features

  • Third-party approval processes

  • Payment confirmation

  • Technical feasibility

  • App store, platform, or service provider rules

  • Communication and content provided by the client

BENIPAL LAB may refuse, cancel, pause, or request clarification for any order if the request is incomplete, unsafe, unlawful, misleading, technically unreasonable, or outside the scope of our services.

4. Client Responsibilities

You agree to:

  • Provide correct and complete information.

  • Check all order details before submitting payment.

  • Respond to reasonable requests for information required to complete the service.

  • Ensure that any content, images, logos, text, brand material, business details, or files you provide are lawful and owned by you or properly licensed.

  • Not upload or submit harmful, illegal, offensive, abusive, fraudulent, or infringing material.

  • Keep your account, device, and contact information secure.

BENIPAL LAB is not responsible for delays caused by incomplete information, late responses, incorrect details, third-party issues, or changes requested after work has started.

5. Payments

BENIPAL LAB may use third-party payment providers such as Stripe, Apple Pay, Google Pay, or other payment systems.

By making a payment, you agree that:

  • Payment details may be processed by secure third-party payment providers.

  • BENIPAL LAB does not directly store full card details.

  • Prices may be displayed in a selected currency where available.

  • Any taxes, bank fees, currency conversion fees, or payment provider charges may depend on your bank, card provider, location, or payment method.

  • Your order may not begin until payment is successfully confirmed.

BENIPAL LAB may change pricing, packages, features, or service availability at any time. Changes will not normally affect an order already confirmed and paid, unless both parties agree otherwise or a correction is required due to an error.

6. Apple Pay, Google Pay, Stripe, and Third-Party Payments

Where Apple Pay, Google Pay, Stripe, or other payment providers are available, their own terms, policies, security checks, and processing rules may apply.

BENIPAL LAB is not responsible for:

  • Payment provider outages

  • Bank declines

  • Card issuer decisions

  • Apple Pay or Google Pay availability

  • Currency conversion fees

  • Delays caused by payment processors

  • Payment method restrictions

If a payment fails, the order may not be submitted or confirmed.

7. Refunds, Cancellations, and Consumer Rights

Refunds and cancellations are assessed based on the type of service, order status, work already completed, and applicable consumer law.

You may request a refund or cancellation by contacting us at:

Because BENIPAL LAB may provide custom digital services, app-related services, development work, consulting, design work, or project-based work, refunds may not be available after work has started, after digital delivery, or after significant resources have been allocated, except where required by applicable law.

Nothing in these Terms limits or removes your rights under New Zealand consumer law or any other law that cannot legally be excluded.

8. Project Timelines and Delivery

Any delivery dates, estimated completion times, progress percentages, or project timelines shown in BENIPAL LAB are estimates only unless confirmed in writing as a fixed deadline.

Timelines may change due to:

  • Client-requested changes

  • Delayed communication

  • Missing information

  • Technical issues

  • Payment delays

  • Third-party service problems

  • App Store, Google Play, Stripe, Firebase, Twilio, or other platform review processes

  • Unexpected development complexity

BENIPAL LAB will make reasonable efforts to deliver services professionally and within reasonable timeframes, but we do not guarantee that every project will be completed by an estimated date unless specifically agreed in writing.

9. App Store, Google Play, and Third-Party Platform Approval

Some projects or services may depend on approval from Apple, Google, payment providers, communication providers, cloud platforms, or other third-party systems.

BENIPAL LAB cannot guarantee:

  • Apple App Store approval

  • Google Play approval

  • Payment provider approval

  • Push notification delivery

  • Third-party API availability

  • Platform policy decisions

  • Search ranking, downloads, revenue, or business results

We may assist with preparation, setup, technical fixes, or submission guidance, but final approval decisions are controlled by the relevant third-party platform.

10. Chat, Calling, Notifications, and Communication Features

BENIPAL LAB may include communication features such as chat, call-related screens, notifications, order updates, support messages, or communication buttons.

You agree not to use communication features to:

  • Harass, abuse, threaten, or harm anyone

  • Send spam or misleading messages

  • Share unlawful or offensive content

  • Impersonate another person or business

  • Attempt to disrupt the app, service, or other users

BENIPAL LAB may monitor, restrict, remove, or disable communication features where required for safety, legal compliance, service quality, or misuse prevention.

Call, chat, notification, and delivery features may rely on third-party providers and may not always be available.

11. Reels, Videos, Media, and User Content

BENIPAL LAB may display reels, videos, images, promotional content, educational content, or user-related content.

If you submit, upload, send, or provide content to BENIPAL LAB, you confirm that:

  • You own the content or have permission to use it.

  • The content does not violate copyright, trademark, privacy, publicity, or other rights.

  • The content is not unlawful, harmful, abusive, misleading, or offensive.

  • BENIPAL LAB may use the content as needed to provide services, display order-related material, support your project, or operate the app.

You retain ownership of your own content, but you grant BENIPAL LAB a limited licence to use, store, process, display, reproduce, modify, and transmit that content as necessary to provide the services.

BENIPAL LAB may remove or refuse content that appears unsafe, unlawful, misleading, infringing, or inappropriate.

12. Intellectual Property

All BENIPAL LAB branding, designs, text, graphics, app layouts, icons, software elements, code, systems, workflows, service structure, and original content are owned by BENIPAL LAB or licensed to BENIPAL LAB unless otherwise stated.

You must not copy, reproduce, resell, modify, reverse engineer, distribute, or exploit BENIPAL LAB materials without written permission.

Any client-provided content remains the property of the client, subject to the licence needed for BENIPAL LAB to provide the service.

For custom projects, ownership of final deliverables may depend on the order, written agreement, payment status, and scope of service. Unless clearly agreed otherwise in writing, BENIPAL LAB may retain ownership of reusable tools, templates, internal systems, source patterns, design methods, backend structures, and general know-how used to create services.

13. Acceptable Use

You must not:

  • Use BENIPAL LAB for illegal or harmful activities.

  • Attempt to hack, damage, reverse engineer, overload, or disrupt the app, website, servers, or systems.

  • Upload malware, harmful code, or unsafe files.

  • Use fake, stolen, or unauthorised payment methods.

  • Submit false, misleading, or fraudulent information.

  • Copy, scrape, resell, or exploit BENIPAL LAB content or services without permission.

  • Interfere with other users or service operations.

  • Use the app or services in a way that damages BENIPAL LAB’s reputation, security, or business operations.

We may suspend, restrict, or terminate access if we reasonably believe these Terms have been breached.

14. Privacy and Personal Information

BENIPAL LAB may collect and process personal information to provide services, communicate with clients, process orders, support payments, deliver notifications, manage projects, improve the app, and comply with legal obligations.

  • Phone or WhatsApp number

  • Payment status

  • Chat or support messages

  • Files or content you provide

15. Third-Party Services

BENIPAL LAB may use or integrate third-party services, including but not limited to:

  • Firebase

  • Twilio

  • Mux

  • Apple App Store services

  • Google Play services

  • Cloud hosting providers

  • Analytics, messaging, notification, or media providers

Third-party services may have their own terms, privacy policies, security requirements, fees, and availability limits.

BENIPAL LAB is not responsible for third-party service failures, policy changes, outages, pricing changes, approval decisions, or technical restrictions.

16. Security

BENIPAL LAB takes reasonable steps to protect the app, website, data, payment flow, communication features, and service systems.

However, no digital system is completely secure. You are responsible for keeping your own device, email account, passwords, payment methods, and contact details safe.

You must notify us immediately if you believe your information, account, order, or communication with BENIPAL LAB has been misused or compromised.

17. Availability and Updates

BENIPAL LAB may not always be available. Access may be interrupted due to:

  • Maintenance

  • Updates

  • Technical faults

  • Internet issues

  • Device compatibility issues

  • Third-party service outages

  • Security incidents

  • Platform restrictions

We may update, modify, suspend, or remove parts of the app, website, or services at any time.

We do not guarantee uninterrupted, error-free, or permanent availability of any feature.

18. No Guaranteed Results

BENIPAL LAB may provide digital services, technical support, app guidance, design work, development work, communication tools, and related services.

However, we do not guarantee:

  • Business success

  • Increased revenue

  • App downloads

  • App Store or Google Play approval

  • Payment provider approval

  • Search engine ranking

  • Social media reach

  • Customer growth

  • Any specific financial outcome

Any examples, screenshots, demonstrations, or service descriptions are for general understanding and do not guarantee the same outcome for every client.

19. Limitation of Liability

To the maximum extent permitted by law, BENIPAL LAB is not liable for indirect, incidental, special, consequential, or business losses, including loss of profit, loss of data, loss of revenue, loss of goodwill, loss of opportunity, service interruption, or third-party platform issues.

Where liability cannot legally be excluded, BENIPAL LAB’s liability will be limited to the maximum extent permitted by applicable law.

Nothing in these Terms limits rights that cannot legally be excluded under New Zealand consumer law or other applicable laws.

20. Indemnity

You agree to indemnify and hold BENIPAL LAB harmless from claims, losses, damages, liabilities, costs, or expenses arising from:

  • Your breach of these Terms

  • Your misuse of the app, website, or services

  • Content or information you provide

  • Your violation of any law or third-party rights

  • Unauthorised or fraudulent use of your account, device, payment method, or submitted information

21. Suspension or Termination

BENIPAL LAB may suspend, restrict, or terminate your access to the app, website, communication features, order flows, or services if:

  • You breach these Terms.

  • Your conduct creates legal, security, payment, or operational risk.

  • You provide false, misleading, abusive, or unlawful information.

  • A payment is disputed, reversed, declined, or suspected to be fraudulent.

  • We are required to do so by law, platform rules, or third-party providers.

Termination does not affect rights or obligations that arose before termination.

22. Changes to These Terms

BENIPAL LAB may update these Terms from time to time.

When we update the Terms, we may change the “Effective Date” at the top of this page. Continued use of BENIPAL LAB after changes means you accept the updated Terms.

23. Governing Law

These Terms are governed by the laws of New Zealand.

Any dispute relating to BENIPAL LAB, these Terms, the website, app, payments, orders, or services will be handled under New Zealand law, unless another law applies and cannot legally be excluded.
